Terms & Conditions


 Shipping Terms:

  • By default SmartFLeX Technology shipments are via lowest available service (UPS Ground, USPS, Fedex). Customers may arrange for their own UPS or FEDEX pick-up service.

  • All Prices are F.O.B. SmartFLeX Technology or a SmartFLeX Technology assigned service partner warehouse. Shipping & handling costs, where applicable, are automatically added to the invoice.

  • All products are thoroughly tested before leaving our warehouse. Report all visibly damaged shipments to the carrier and us immediately. If the product is damaged due to mishandling, immediately file an insurance claim with the responsible carrier. SmartFLeX Technology is not responsible for carrier damaged products.

  • Improper or inadequate packing causing damages during return shipments of any kind are the sole responsibility of the customer. SmartFLeX Technology will not handle received damaged product without prior written authorization of the shipper.

Payment Policy:

  1. All prices are F.O.B. SmartFLeX Technology, Inc. or a SmartFLeX Technology assigned service partner WAREHOUSE.

  2. All invoices must be paid in full within assigned credit terms. If payments are not received at the date as listed on our invoice in the "payment due" section, any further shipment(s) will be charged C.O.D. or must be pre-paid until we re-establish credit terms. All late payments will be charged with 2.5% interest/month. All past due invoices will automatically be turned over to our company lawyer for collection proceedings. Any legal fees will be added to the account.

  3. Credit Terms may be granted at the sole discretion of SmartFLeX Technology, Inc. after a review of required credit information. Until credit terms are established and for the first three (3) shipments all products are shipped C.O.D. or pre-paid. All consulting, repair or service invoices are due immediately. All training class fees are due before class starts.

  4. Payment Methods: Checks, Credit Cards, PayPal, C.O.D, Wire Transfers. We are  PayPal Seal and accept Credit Card Logos

Warranty:

Unless otherwise provided by law or specified in the policy below, SmartFLeX Technology, Inc. DISCLAIMS ANY AND ALL PROMISES, REPRESENTATIONS, AND WARRANTIES EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, WITH RESPECT TO ANY MATERIAL FURNISHED HEREUNDER, OR ANY COMPONENT THEREOF, INCLUDING THE CONDITION, THE CONFORMITY TO ANY REPRESENTATION OR DESCRIPTION, THE EXISTENCE OF ANY LATENT OR PATENT DEFECTS, AND THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE THEREFOR.

Limited Warranty:

Within the time specified below, SmartFLeX Technology, Inc. (SmartFLeX Technology) warrants that its products are free from defects. During the respective periods of times, SmartFLex Technology will repair the defective products. SmartFLeX Technology is not liable for any consequential damages caused by the product itself or by the use of the product. Warranty is effective from the date of original invoice issue by SmartFLeX Technology. SmartFLeX Technology's warranty liability is limited to the purchase price of the merchandise. Incompatibility reasons are excluded.

Warranty will be voided for any one of the following reasons:

  • Warranty expiration;

  • Removal of the serial number or anti- tampering labels;

  • Non-payment of open invoices;
  • Mishandling, tampering, improper use, overheating and other abuse of the product; or

  • Improper or inadequate packing causing damages during return.

The terms of warranty are only countable to our direct customers.

  • Motherboard: SmartFLeX Technology provides one-year limited warranty, or according Manufacturer's Warranty Policy, whichever is longer.

  • CD-ROM/DVD/Mouse/Memory Chips/ Other Peripherals: One year limited warranty.

  • CPU: 30-day limited warranty or according Manufacturer's Warranty Policy, whichever is longer.

  • Mechanical, Magnetic or Optical Drives: One year or according to Manufacturer's Warranty Policy, whichever is longer.

Choice of law:

In case of disputes, all parties agree and hereby irrevocably submit to the exclusive jurisdiction of the federal courts, and state and municipal courts of the Commonwealth of Pennsylvania.

RMA POLICY:

General Policy:

A Return Merchandise Authorization (RMA) number must be optained before returning any item to us. To obtain an RMA number, please provide in writing via fax (610-500-5079) or e-mail ( This e-mail address is being protected from spambots. You need JavaScript enabled to view it ) the following requirements:

  • Company name, Contact person, Description of the item to return, Detailed reasons for the return, Serial number of the item, Copy of the invoice. No RMA number will be issued without this information provided!

  • A RMA number will be void if the item is not received by SmartFLeX Technology within fifteen working days upon issuance of the RMA number. Customers must pay for the return freight.

  • Items sent to SmartFLeX Technology without an RMA as specified above may be refused and returned to sender via freight collect.

  • Products returned under this RMA policy, proven not to be defective, are subject to a $ 50.00 testing fee and return shipment costs.

DOA (Dead on Arrival/Defective) items must be received within 10 days from the invoice date for replacement.

Return for Credit:

  • Generally, all SALES ARE FINAL, and credit will only be considered after carefully evaluating the special circumstances involved.

    All return for credit must be processed through and agreed to by our sales department. An RMA number will be issued for credit return. Any returned merchandise without a valid RMA number will be rejected on delivery to our premises.

  • To receive credit, products must not be damaged or mishandled in any way, and must be returned within 10 days from the invoice date. Items returned for credit must be accompanied with a copy of the invoice and must be in their original undamaged packaging, including manuals, cables, accessories, if applicable, in substantially the same condition as purchased.

RMA/Repair return Shipping:

All items are send back to customers via ground service, unless otherwise specified. Request for special delivery (air, overnight, 2nd day, or 3rd day) must be made in writing and will be made by cash on delivery (C.O.D.)


**Please note, that all retired items that cannot be repaired or replaced during Warranty will be reimbursed by an equivalent item, which could be repaired or refurbished by manufacturer.
